Default claim my father and brother as dependents since i pay for over half of their support

My father and brother live with me. they have all year, and receive food stamps and medicaid. I pay for over half on everything for them, except the couple hundred dollars a month in food stamps. things like clothes, gas, utilities, and even food when their stamps run out. would i be eligible to claim them as dependents on my tax return?

Is your income reported to the agencies providing them with benefits? If not, it's fraud.

Legally it is possible. Does food stamps know you are supporting them? If not, they could lose their benefits. They would have to pay them back plus penalties. They could prosecute them for benefits fraud but most likely will not.

On the Medicaid application, you have to say if you are claimed as a tax dependent on anyone's tax return. They would have to inform Medicaid if you do claim them, and that could change that benefit or have a share of cost. Have they reported that you support them when they got food stamps? Probably not. They are committing fraud and that is a federal crime if they decide to prosecute.

$200 a month in food stamps is a high amount for 2 people. You would have to be paying more than one half of everything they spend all year and that includes rent. You have to prove what you have paid for them if you get audited.

If they dont have any income and you are their main means of support, you probably can claim them but again, they must report this to Social Services.
