Default my mother has been living off of life insurance money under my name my entire life... sue her

My father died when I was 2 and his life insurance left social security for both my mother and I. My mother's half was to help with living needs and mine was apparently supposed to be saved for college or the future or whatnot. Well for the majority of my life all my mom did was sit on her fat, lazy, unemployed ass and lived off of both her part and mine of the social security funding and I never once saw a dime of it outside of her giving me a few bucks (of money that was already under my name) every now and then as a sort of allowance. My question is, would there be anyway I could sue or in anyway deface her for what she did? If you plan to comment telling me your moral stand point on the situation then I kindly say go f*** yourself and your opinion.

I don't see in your question where she had life insurance. She got additional Social Security from the government because she had a child, to help raise that child. So, if you ate and had a home, that was its purpose. Regardless, the funds came in a check payable to her.

Social Security Survivor Benefits is what you are talking about. Sorry, but you do not get it. It is given to parents for their minor children.

Good news is that it stops at age 18 so your mom will be looking for a job or other income because her payday just ran out. Sorry that you had no dad and your mom didn't do more.

Social security is not life insurance. If you were entitled to social security benefits because of your father's death, then that money could legally be used to help care for you while growing up. If it was an actual Insurance policy where you were named a beneficiary the money would have been held in trust until you reached adulthood. I doubt you have any case against your Mother and any action on your part will just confirm that you are an immature,ungrateful brat that thinks the world owes him a living.

Survivor benefits is NOT life insurance! She can basically do what she wanted w/this money until your 18th birthday. "Your money" was to be put for clothes, food and shelter. She did NOT have to put it away for college that would have been up to her. Not many parents save for their kids college anyway. Get over yourself and drop the attitude.

Sure you can hire a lawyer and sue her. You'll likely lose.

Social security and life insurance are two different things. It's NOT to be saved for college - social security for kids, is to be used to pay for utilities and rent and childcare and clothing and school supplies and food and medical care and even gas for the car, to transport the kid to school or where ever.

You're not EVER entitled to lay your hands on that welfare money. EVER. That's why it doesn't come IN YOUR NAME.

You've ALREADY "defaced" her with your attitude.

So get over it, get off YOUR fat lazy unemployed @ss, and go earn your own living.

I'm guessing that from the time you were 2 until now, you had a roof over your head, had food in your belly and were clothed. Right?

Then the SS benefits WERE used for you.

Just for clarification, Life insurance and social security are two separate things. Your dad's social security benefits would have come to your mom to help raise you until you reach 18yr.
The life insurance money cannot go to a minor because it is a legal contract and a minor cannot sign for it, so he probably left the life insurance money to your mother. In which case, she can legally do with it whatever she wants. If you have access to the life insurance contract, you can see how the beneficiary is listed. If you don't have a paper trail to prove that your mother used funds meant for you, then there is really nothing anyone can do to help you with that.
Alternatively, if your goal is to attend college, and all of the insurance money has been depleted, you will clearly qualify for financial aid and there are numerous options you can look into.

Life insurance does not leave "social security"/
Social security survivors benefits is from the Social Security Administration. As a minor, your social security survivors benefits is given to your caretaker (your mom) to cover expenses like housing, food, and clothes.

Social security survivors benefits are never given directly to a minor. The only time a minor can get these benefits is if the caretaken gives them to the individual.

If your mom provided shelter, food, clothing, and some spending money sometimes, while unemployed - it sounds like the money was used for exactly as it is intended.
